Resolution 2016-63 -  Acceptance of Offsite Sewer Utility Easement for Witherspoon Development. 
Background
A condition of approval for the Witherspoon/Holt development project included installing offsite sewer at two separate locations: one to the west at Aberdeen Drive and one to the south in the Oakhall common space.  In order for the offsite sewer at Oakhall to be installed, the developer, on behalf of the City, was required to obtain a utility easement from the adjacent property owner, Mr. Frank Stubblefield.  Mr. Stubblefield owns the land to the south between the development and the location of the existing sewer line where the connection will be made.  Accordingly, the developer obtained an appraisal for the requested sewer line easement and negotiated the purchase of the easement from Mr. Stubblefield.  

Staff is recommending that the easement be accepted by the Board of Commissioners.  If acceptance is authorized, the easement will become the property of the City for future maintenance of the sewer line by the Water Services Department.  Upon acceptance, the easement document will be recorded at the County Records Office and a copy returned to Mr. Stubblefield.

Note that an additional easement across Oakhall subdivision open space will also be required.  The developer is finalizing negotiations with the HOA and acceptance of that easement will be presented to the Board at a future meeting.

Staff recommends acceptance of the utility easement.  
Previous Commission Action
At the October 26, 2015, the Board of Commissioners approved Ordinance 2015-12, rezoning the subject property.
